Assault accused remanded in custody

Arrested in connection with a stabbing in Kinnegad last Saturday, a Dublin man has been remanded in custody, with consent to bail. Steven Kinsella from Belcamp Crescent, Coolock appeared before Judge Seamus Hughes at a sitting of Athlone District Court yesterday (Wednesday).

Kinsella, who was said to be living in Kinnegad, with his partner and young family, was charged with assaulting Joseph Berry, thereby causing him harm, contrary to Section 3 of the Non Fatal Offences Against the Person Act at Heathfield, Kinnegad on October 4. He is further charged with possessing a blade which was sharply pointed, contrary to Section 9 (5) of the Firearms and Offensive Weapons Act on the same occasion.

Garda Robbie Feery, Mullingar gave evidence of arresting the accused at Malahide Road, Dublin on Monday last and charging him with the offences.

He told Judge Hughes that the victim, Joseph Berry (22) was in a stable condition in Tallaght Hospital. He opposed the granting of bail and asked that the accused be remanded in custody.

Counsel for Mr Kinsella said his client was keen to avail of bail and would accede to any conditions which the State might impose.

Granting bail, Judge Hughes sought an independent surety of €5,000, €2,500 of which was to be cash, along with Mr Kinsella's own surety of €1,000. Imposing conditions, Judge Hughes ordered that Mr Kinsella reside with his mother in Belcamp Crescent, sign on daily at Coolock Garda Station, surrender his passport and not apply for any other travel documentation, provide gardaí with a mobile telephone number and have no contact, direct or indirect, with the injured party or witnesses.

Mr Kinsella was remanded in custody, with consent to bail to appear at Cloverhill District Court on Wednesday next, November 15.
