No evictions at registrars court in mullingar

There were no evictions at the June sitting of the County Registrar’s Court, which was held in Mullingar yesterday, Monday June 8.

In total, over 60 cases came before County Registrar Elizabeth Sharkey, all of which were adjourned to later in the year.

Speaking to the Westmeath Examiner, a spokesperson for the Westmeath Land League, members of which staged a protest outside of the court during the proceedings, voiced his satisfaction at the lack of evictions this month.

He attributed the lack of repossessions – and the unusually large number of requests for adjournments by members of the legal profession representing lenders – down to the recent High Court ruling that Cavan Circuit Court didn’t have the jurisdiction to grant a repossession order against a Kingscourt couple, Chris Ward and Laura Finnegan.

“Westmeath Land League informed the registrar by letter last Friday that the impending cases coming before her court should not be dealt with as the court does not have jurisdiction following the Ward Finnegan case,” he said.

A number of lawyers representing lenders cited the Ward Finnegan case when they asked for adjournments, while one mortgage holder questioned whether the registrar had jurisdiction to deal with the repossession order relating to his Rochfortbridge home.

The county registrar said that she would put the case on the “judge’s list”.

“Any matter than I am not disposed to deal with, I have jurisdiction to transfer to the judge’s list,” she said.
