Man accused of trying to attack brother with weapons is due back in court this week

A Mullingar man is due to appear at a sitting of the District Court this week charged with possessing weapons in a bid to try and assault his brother.

Shane Gavin (24) of Grange Lawns, Mullingar, Westmeath, is scheduled to come before the court on Thursday, having appeared two weeks earlier charged with possessing a Stanley knife and producing a “metal bladed implement” which was capable of “inflicting serious injury” at Grange Lawns, Mullingar on July 20, 2024.

Sgt Orla Keenan, in outlining the state case, said it will be alleged gardaí were called to the housing estate just after 3pm. She said when officers arrived, they were informed that Mr Gavin had been in the area twice inside a matter of minutes, armed with weapons.

Sgt Keenan said on the first occasion, the accused was confronted by his older brother while brandishing a Stanley knife.

The court heard how it will be alleged that the accused returned to the scene a short time later with what was described as a “metal bladed” curved implement. Mr Gavin, it was alleged, left the area for a second time.

The prosecution will allege, the court heard, that Mr Gavin came on the scene to “confront another brother” of his, and he tried to gain access to a house.

Mr Gavin was later arrested at a different location and that led to both charges being brought before the court.

Jurisdiction, a legal term used to decide whether a case is suitable to remain in the District Court or be sent forward to the Circuit Criminal Court, was accepted.

No plea, or indication of one, was put forward by Mr Gavin as defence solicitor, Louis Kiernan, applied for a disclosure order to be made.

That application was granted and Mr Gavin was remanded on bail to appear at Mullingar District Court on October 9.
