Man accused of leaving alleged stab victim in hospital to stand trial at Circuit Criminal Court
A man in his 40s is to stand trial next month accused of leaving another man in hospital after allegedly stabbing him in the stomach 18 months ago.
Mariusz Malecki (46) with an address at The Court, Marketpoint, Mullingar, Westmeath, was served with a book of evidence at last week’s sitting of Mullingar District Court arising from an incident at The Green, Bun Daire, Kinnegad, Westmeath on February 4, 2024.
Malecki, who is in custody on an unrelated matter, was charged with assault causing harm to a named male, and the possession and production of a knife during the course of a fight.
The alleged victim sustained a puncture wound to the left side of his body and was taken by ambulance to the Midland Regional Hospital Mullingar.
The accused, who wore a blue shirt, black jacket and tracksuit bottoms to court, remained silent in the custody area of the courtroom as Garda Enda Reddan gave sworn evidence of having served the book on Malecki ahead of the commencement of court business.
Sgt Sheila Kenny said the Director of Public Prosecutions had consented for Malecki to be sent forward to the Circuit Criminal Court on both charges.
Judge Deirdre Gearty addressed Malecki by giving him the alibi warning, telling him of his duty to notify the state within 14 days of any alibi evidence he wished to depend on during the course of his trial.
Andrea Callan, BL, defending, said her client was already subject to legal aid and asked for that order to extend to the assigning of a junior counsel.
Judge Gearty endorsed that request and adjourned the case to Mullingar Circuit Criminal Court on November 27.
